But in the\u00a0roughly 12\u00a0minutes ahead I will\u00a0attempt\u00a0to offer just a brief overview of what could be a description of those obligations, what they entail, and how and why\u00a0they\u2019re\u00a0not being fulfilled. Colleagues in the afternoon will offer a more in-depth analysis of some of these elements.<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559739&quot;:240,&quot;335559740&quot;:240}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">Firstly: all EU member states are parties to the UN Genocide Convention.<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559739&quot;:0,&quot;335559740&quot;:240}\">\u00a0<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559739&quot;:0,&quot;335559740&quot;:240}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">Governments, scholars, NGOs may differ, in good or in bad faith, about whether what Israel has been doing in Gaza reaches the legal threshold of the crime of genocide. But when it comes to the obligations stemming from the UN Genocide Convention, there can be no doubt as to the existence of the duty to prevent the crime of genocide.\u00a0<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559739&quot;:0,&quot;335559740&quot;:240}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">That duty entails an obligation to \u201c<\/span><i><span data-contrast=\"auto\">employ all means reasonably available to [states parties], so as to prevent genocide so far as possible<\/span><\/i><span data-contrast=\"auto\">\u201d.\u00a0The duty arises as soon as a state learns, or should normally have learned, of a\u00a0<\/span><i><span data-contrast=\"auto\">serious risk<\/span><\/i><span data-contrast=\"auto\">\u00a0that genocide may be committed. A definitive determination that genocide is already underway is not\u00a0required.<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559739&quot;:0,&quot;335559740&quot;:240}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">So, the questions are: is there a serious risk that Israel may have been committing genocide? Is the EU aware of it? So yes, there is\u00a0a the\u00a0very least, a serious risk<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559739&quot;:0,&quot;335559740&quot;:240}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">Was the EU aware of this serious risk? Yes.\u00a0<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559739&quot;:0,&quot;335559740&quot;:240}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">Besides all information available to their diplomats in The Hague, New York, Geneva, EU foreign ministers themselves have been repeatedly briefed by the EU Special Representative for Human Rights, by leading humanitarian agencies, and by the UN High Commissioner for Human Rights. Yes, they\u00a0knew,\u00a0they\u00a0know.<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559739&quot;:0,&quot;335559740&quot;:240}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">So, the last question: did they fulfil their duty to prevent a genocide? No, they did not.<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559739&quot;:0,&quot;335559740&quot;:240}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">They have many persuasive means at their disposal but chose not to use them. And on top of the failure to act, some EU states continued to provide Israel with military, economic and political support.<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559739&quot;:0,&quot;335559740&quot;:240}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">What are the tools the EU should use, and what does it take to trigger them?<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559739&quot;:0,&quot;335559740&quot;:240}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">Firstly, they should stop arms transfers and transit. The Arms Trade Treaty, the EU\u2019s Common Position 2008\/944 and general international law all bind the EU not to export arms to Israel,\u00a0as long as\u00a0there is a serious risk that those arms could be used for international crimes.\u00a0<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559739&quot;:0,&quot;335559740&quot;:240}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">Despite that, Germany,\u00a0France\u00a0and other EU states continue to export arms to Israel.<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559739&quot;:0,&quot;335559740&quot;:240}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">A\u00a0EU-wide arms embargo would require unanimity, but each\u00a0member\u00a0state can decide on their own to halt export licenses and transfers, as some in fact did.<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559739&quot;:0,&quot;335559740&quot;:240}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">Secondly, they should adopt targeted sanctions against Israeli officials responsible for war crimes or other serious abuses.\u00a0<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559739&quot;:0,&quot;335559740&quot;:240}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">Those sanctions require unanimity. For several EU states, sanctioning Israeli officials is still a no-go. They only allowed a few sanctions against settlers, despite overwhelming evidence of settlers being\u00a0state-backed; and in any case, those sanctions are\u00a0largely unrelated\u00a0to Gaza, where the 27 have yet to unanimously acknowledge in a statement that a single war crime was committed by Israeli authorities.<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559739&quot;:0,&quot;335559740&quot;:240}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">Some member states claim Israeli officials\u00a0shouldn\u2019t\u00a0be sanctioned because, they say, Israel is a democracy, and it would be up to Israeli people and institutions to\u00a0take action. Now, regardless of what one\u2019s views may be about the democratic nature of Israel and a democracy\u2019s compatibility with apartheid, it must be stressed that nowhere does international law provide that only undemocratic states can commit genocide. Holding elections does not exonerate a party from the crime of genocide \u2013 nor from war crimes, crimes against humanity, torture, apartheid, or any other grave crime under international law.<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559739&quot;:0,&quot;335559740&quot;:240}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">Thirdly, the EU should suspend at least the trade pillar of the EU-Israel Association Agreement. The measure was first requested by Spain and Ireland already in February 2024, but it\u00a0wasn\u2019t\u00a0until May 2025 that a\u00a0<\/span><i><span data-contrast=\"auto\">review<\/span><\/i><span data-contrast=\"auto\">\u00a0of Israel\u2019s compliance with its human rights obligations, which\u00a0constitutes\u00a0an essential element of the agreement, was supported by\u00a0a majority of\u00a0member states. The findings, in July 2025, were obviously damning. And\u00a0itr\u00a0wasn\u2019t\u00a0until September, amid a famine in Gaza, that President von der Leyen proposed a suspension of the trade pillar of the agreement \u2013 which\u00a0wouldn\u2019t\u00a0ban trade, but simply reinstate tariffs.<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559739&quot;:0,&quot;335559740&quot;:240}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">Since then, the proposal has been \u201con the\u00a0table\u201d \u2013\u00a0and only there, yet to be adopted.\u00a0<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559739&quot;:0,&quot;335559740&quot;:240}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">Israel\u2019s recent discriminatory death penalty bill and escalation of attacks, mass\u00a0displacement\u00a0and threats to commit atrocities in Lebanon revived pressure to suspend the agreement.<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559739&quot;:0,&quot;335559740&quot;:240}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">The measure is also widely supported by European NGOs and trade unions and the European Parliament, and a European citizen petition reached the required 1 million signatures in just 3 months, breaking any record. But there is still not enough support from\u00a0EU\u00a0governments.<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559739&quot;:0,&quot;335559740&quot;:240}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">A qualified majority is necessary to suspend the trade pillar, meaning 55% of EU states\u00a0representing\u00a0at least 65% of the EU population. Opposition by Germany and Italy alone, 2 of the 3 most populous EU countries, almost suffices to form a blocking minority, which is easily reached adding strong Israel-supporters Czechia,\u00a0Hungary\u00a0and Austria, among others.<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559739&quot;:0,&quot;335559740&quot;:240}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">The suspension of the whole Association Agreement would instead require unanimity, which is completely out of reach politically.\u00a0<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559739&quot;:0,&quot;335559740&quot;:240}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">The obligations for the EU, however, do not only stem from the UN Genocide Convention, but also from general international law.<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559739&quot;:0,&quot;335559740&quot;:240}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">In July 2024, the International Court of Justice found Israel\u2019s very presence in the Occupied Palestinian Territory to be unlawful and marred by serious abuses \u2013 including apartheid. The Court made clear that all settlements, old and new alike, should be dismantled and the lands returned to Palestinians, who are entitled to reparations.<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559739&quot;:0,&quot;335559740&quot;:240}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">Last year, France co-led UN efforts culminating in the adoption of the New York Declaration on a 2-state solution. Interestingly, par. 30 of the declaration includes a commitment to take concrete action,\u00a0<\/span><span data-contrast=\"auto\">in line with the ICJ ruling<\/span><span data-contrast=\"auto\">, to \u201c<\/span><i><span data-contrast=\"auto\">help realize the right of the Palestinian people to self-determination and to counter the illegal settlement policy in the occupied Palestinian territory, including East Jerusalem, and policies and threats of forcible displacement and annexation.<\/span><\/i><span data-contrast=\"auto\">\u201d<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559739&quot;:0,&quot;335559740&quot;:240}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">Now, par. 278 of the ICJ ruling clarifies that all states have an obligation to \u201ctake steps to\u00a0<\/span><i><span data-contrast=\"auto\">prevent<\/span><\/i><span data-contrast=\"auto\">\u00a0trade or investment relations that assist in the maintenance of the illegal situation created by Israel in the OPT\u201d. In February last year, Human Rights Watch, along with\u00a0other 162\u00a0European NGOs and trade unions called for a ban on EU trade with settlements. Several EU member states have asked for the same, as have recently\u00a0some\u00a060 Members of the European Parliament from across the political spectrum.<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559739&quot;:0,&quot;335559740&quot;:240}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">But regrettably, the Commission claims its policies are broadly in line with the ICJ\u00a0ruling\u00a0and no further action is\u00a0required. We sharply disagree.<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559739&quot;:0,&quot;335559740&quot;:240}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">Given the Commission\u2019s position, Spain once again stood out and adopted a unilateral ban of trade in goods and services with the settlements. The Netherlands, Slovenia, Belgium and Ireland are considering similar measures. At the latest gathering of EU foreign ministers, Sweden and France circulated a proposal for high tariffs on settlement goods. The proposal helps triggering discussions, but its adoption would be underwhelming and would not satisfy the obligations laid out by the ICJ ruling. It wouldn\u2019t prevent trade; it would at best only make it less profitable. A complete ban is needed, regardless of tariffs.<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559739&quot;:0,&quot;335559740&quot;:240}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">Settlements are illegal.\u00a0They\u2019re\u00a0built on stolen land. They result from war crimes &#8211; the transfer of civilian population from an occupying power to an occupied territory, which is forbidden by\u00a04th\u00a0Geneva Convention and by the Rome Statute. There is no lawful way to trade with them. Their very\u00a0<\/span><i><span data-contrast=\"auto\">existence<\/span><\/i><span data-contrast=\"auto\">\u00a0deprives Palestinians of access to their land \u2013 on top of the ethnic cleansing, the murders, violence, torture, apartheid, daily\u00a0humiliation\u00a0and oppression Palestinians are subject to by Israeli forces and settlers.<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559739&quot;:0,&quot;335559740&quot;:240}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">25 of the 27 EU states voted in favour of the New York Declaration. All EU states agree that the settlements are illegal and call them an obstacle to the 2-state solution that they claim to pursue. And yet, they keep trading with those obstacles, that only keep expanding.<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559739&quot;:0,&quot;335559740&quot;:240}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">Last but not least, all EU member states are parties to the Rome Statute of the ICC, and EU and its member states have made legally binding commitments to support the court\u2019s independence and to ensure\u202fcooperation. But when in 2024 the ICC issued arrest warrants against Israeli prime minister Netanyahu and former\u00a0defence\u00a0minister Gallant for atrocities in Gaza, several EU states criticized the Court\u2019s decision and put into question their obligation to arrest Netanyahu.\u00a0<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559739&quot;:0,&quot;335559740&quot;:240}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">Infamously, Hungary decided to leave the Court and hosted Netanyahu, refusing to\u00a0comply with\u00a0its obligation to arrest him. Hungary\u2019s prime minister-elect Magyar has now flagged his intention to stay in the\u00a0ICC, and\u00a0stated that the country will\u00a0comply with\u00a0all arrest warrants.\u00a0<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559739&quot;:0,&quot;335559740&quot;:240}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">Your excellencies, distinguished guests, friends, I\u2019ll conclude by stating that the same disregard for international law Israeli authorities have demonstrated for decades, and perhaps most brutally over the past 2 and a half years, against the Palestinians, is being displayed in Lebanon, in the occupied Golan Heights, and in attacks in Iran and Yemen.<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559739&quot;:0,&quot;335559740&quot;:240}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">Those\u00a0very serious\u00a0abuses have continued and are enabled by impunity. An impunity granted also by Europe\u2019s inaction, which comes at an unbearable human, and economic, cost for millions, in the region and beyond.<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559739&quot;:0,&quot;335559740&quot;:240}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">To be clear: Europe does not have a monopoly of double standards. Also, it leads on accountability efforts for many other conflicts and\u00a0abuses, and\u00a0is the world\u2019s leading humanitarian donor \u2013 including on Palestine.<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559739&quot;:0,&quot;335559740&quot;:240}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">But when it comes to Israeli crimes, the crimes that make that humanitarian aid necessary, the EU has chosen not to act. In part, the\u00a0bloc\u00a0is a victim of its own architecture, given the various majorities or unanimity that I mentioned earlier.
