which is the seat of the International Court of Justice.<\/p><\/div>\n<p>&nbsp;<\/p>\n<blockquote><p><strong>The UN International Court of Justice (ICJ) on Friday declared that Israel\u2019s continued presence in the Occupied Palestinian Territory \u201cis unlawful\u201d, and that \u201call States are under an obligation not to recognize\u201d the decades-long occupation.<\/strong><\/p><\/blockquote>\n<p>The Court was responding to a\u00a0<em><a href=\"https:\/\/www.un.org\/unispal\/document\/res-77-247\/\" target=\"_blank\" rel=\"noopener noreferrer\">request<\/a><\/em>\u00a0for an advisory opinion by the General Assembly on the\u00a0<em>legal consequences arising from the policies and practices of Israel in the Occupied Palestinian Territory, including East Jerusalem<\/em>.<\/p>\n<p>The advisory from the\u00a0<em>ICJ<\/em>\u00a0is a legal opinion provided by the Court on questions of international law.<\/p>\n<p>Unlike judgments in contentious cases between States, advisory opinions are non-binding and are sought by Â鶹APP bodies such as the General Assembly or the\u00a0Security Council.<\/p>\n<p>While not legally binding, advisory opinions can shape international policies, increase moral pressure, and unilateral measures adopted by individual States such as sanctions.<\/p>\n<h2><strong>Israel\u2019s obligations<\/strong><\/h2>\n<p>In its\u00a0<em><a href=\"https:\/\/www.un.org\/unispal\/document\/advisory-opinion-icj-19jul24\/\" target=\"_blank\" rel=\"noopener noreferrer\">advisory opinion<\/a><\/em>, the ICJ concluded that Israel\u2019s continued presence in the Occupied Palestinian Territory is unlawful and that it is under an obligation to bring to an end its unlawful presence \u201cas rapidly as possible\u201d.<\/p>\n<p>Israel is also \u201cunder an obligation to cease immediately all new settlement activities and to evacuate all settlers from the Occupied Palestinian Territory,\u201d the opinion continued, as well as \u201creparation for the damage caused to all natural or legal persons concerned\u201d.<\/p>\n<h2><strong>States\u2019 obligations<\/strong><\/h2>\n<p>It further stated that \u201call States are under an obligation not to recognize as legal the situation arising from the unlawful presence\u201d of Israel.<\/p>\n<p>States are also under the obligation to \u201cnot to render aid or assistance in maintaining the situation created by the continued presence of the State of Israel in the Occupied Palestinian Territory\u201d.<\/p>\n<h2><strong>International organizations\u2019 obligations<\/strong><\/h2>\n<p>For international organizations, including the UN, the Court noted the \u201cobligation not to recognize as legal the situation arising from the unlawful presence\u201d of Israel.<\/p>\n<p>The ICJ further noted that UN, and especially the General Assembly and the Security Council, \u201cshould consider the precise modalities and further action required to bring to an end as rapidly as possible the unlawful presence of the State of Israel in the Occupied Palestinian Territory.\u201d<\/p>\n<h2><strong>Call for engagement<\/strong><\/h2>\n<p>Following the issuance of the opinion, UN\u00a0Secretary-General Ant\u00f3nio Guterres\u00a0reiterated his call for the parties to re-engage on the \u201clong-delayed political path\u201d towards ending the occupation and resolving the conflict in line with international law, relevant UN resolutions and bilateral agreements.<\/p>\n<p>\u201cThe only viable path is the vision of two States \u2013 Israel and a fully independent, democratic, contiguous, viable and sovereign Palestinian State \u2013 living side by side in peace and security within secure and recognized borders, on the basis of the pre-1967 lines, with Jerusalem as the capital of both States,\u201d his spokesperson said in a\u00a0<em><a href=\"https:\/\/www.un.org\/unispal\/document\/sg-statement-19jul24\/\" target=\"_blank\" rel=\"noopener\">statement<\/a><\/em>.<\/p>\n<p>The statement also noted that the UN chief will promptly transmit the advisory opinion to the General Assembly, which had requested the Court&#8217;s advice.<\/p>\n<p>\u201cIt is for the General Assembly to decide how to proceed in this matter,\u201d the statement added.<\/p>\n<h2><strong>Israel\u2019s response<\/strong><\/h2>\n<p>According to media reports, Israel\u2019s Foreign Ministry rejected the ICJ\u2019s opinion as \u201cfundamentally wrong\u201d and \u201cblatantly one-sided\u201d.<\/p>\n<p>It also repeated its stance that a political settlement in the region can only be reached through \u201cdirect negotiations\u201d.<\/p>\n<h2><strong>General Assembly request<\/strong><\/h2>\n<p>The General Assembly adopted a resolution in December 2022, which among other points requested the ICJ to provide its opinion under\u00a0<em><a href=\"https:\/\/legal.un.org\/repertory\/art96.shtml\" target=\"_blank\" rel=\"noopener\">Article 96<\/a><\/em>\u00a0of the\u00a0<a href=\"http:\/\/www.un.org\/en\/charter-united-nations\/index.html\"><em>UN Charter<\/em><\/a>\u00a0and\u00a0<a href=\"https:\/\/www.icj-cij.org\/statute#CHAPTER_IV\" target=\"_blank\" rel=\"noopener noreferrer\"><em>Article<\/em> <em>65<\/em><\/a><em>\u00a0<\/em>of the\u00a0<a href=\"https:\/\/www.icj-cij.org\/statute\" target=\"_blank\" rel=\"noopener noreferrer\"><em>Court\u2019s Statute<\/em><\/a><em>.<\/em><\/p>\n<p>The opinion lays out the legal consequences of Israel\u2019s \u201congoing violation\u201d of the right of the Palestinian people to self-determination, from its prolonged occupation, settlement and annexation of territories occupied since 1967, and discriminatory measures, including those affecting Jerusalem\u2019s demographic composition and status.<\/p>\n<p>It also sought to understand how these policies and practices of Israel affect the legal status of the occupation and its legal
