At the Council\u2019s inception in the shadows of the Second World War, \u201cveto\u201d power, though\u00a0<a href=\"https:\/\/legal.un.org\/repertory\/art27.shtml\">not explicitly mentioned in the Charter<\/a>, was granted to its five permanent members (China, France, Russia, United Kingdom, and the United States) because of their\u00a0<a href=\"https:\/\/www.un.org\/securitycouncil\/content\/voting-system\">key roles<\/a>\u00a0establishing the UN.<\/p>\n<p>Despite decades-long efforts to\u00a0<a href=\"https:\/\/www.un.org\/en\/ga\/screform\/\">reform the Council<\/a>, the veto remains in the hands of the Council\u2019s permanent members, colloquially known as the \u201cP5\u201d.<\/p>\n<p>So, when any of the P5 vote \u201c<a href=\"https:\/\/research.un.org\/en\/docs\/sc\/quick\">no<\/a>\u201d in the Council, they invoke this power. That\u2019s what happened on 18 October, when the US\u00a0<a href=\"https:\/\/news.un.org\/en\/story\/2023\/10\/1142507\">vetoed<\/a>\u00a0a new Brazilian proposal.<\/p>\n<p>Going forward, Council members may resolve their differences and table a new draft for a vote or call on the wider UN membership \u2013 the 193 Member States that make up the General Assembly.<\/p>\n<div class=\"align-right context-un_news_large_credit type-entermedia_image media media--type-entermedia-image media--view-mode-un-news-large-credit\" data-quickedit-entity-id=\"media\/126732\">\n<div class=\"field field--name-thumbnail field--type-image field--label-hidden field__item\"><img decoding=\"async\" class=\"lazyload aligncenter\" title=\"Members of the UN Security Council vote on a draft resolution draft resolution on the situation in the Middle East.\" src=\"data:image\/svg+xml,%3Csvg%20xmlns%3D%27http%3A%2F%2Fwww.w3.org%2F2000%2Fsvg%27%20width%3D%27770%27%20height%3D%27420%27%20viewBox%3D%270%200%20770%20420%27%3E%3Crect%20width%3D%27770%27%20height%3D%27420%27%20fill-opacity%3D%220%22%2F%3E%3C%2Fsvg%3E\" data-orig-src=\"https:\/\/global.unitednations.entermediadb.net\/assets\/mediadb\/services\/module\/asset\/downloads\/preset\/Libraries\/Production%20Library\/18-10-2023-UN-Photo-SC-Gaza.jpg\/image770x420cropped.jpg\" alt=\"Members of the UN Security Council vote on a draft resolution draft resolution on the situation in the Middle East.\" width=\"770\" height=\"420\" \/><\/div>\n<div class=\"field field--name-field-authors field--type-entity-reference field--label-hidden field__items\">\n<div class=\"field__item\" style=\"text-align: center\">UN Photo\/Manuel El\u00edas<\/div>\n<\/div>\n<\/div>\n<h2><strong>Vetoing the veto<\/strong><\/h2>\n<p>At the same time, UN Member States can request the Assembly President to convene to scrutinize the recent Council veto, as it did in\u00a0<a href=\"https:\/\/press.un.org\/en\/2023\/ga12528.doc.htm\">early September<\/a>.<\/p>\n<p>That\u2019s thanks to the world body\u2019s unanimous\u00a0<a href=\"https:\/\/news.un.org\/en\/story\/2022\/04\/1116982\">adoption<\/a>\u00a0of a\u00a0<a href=\"https:\/\/undocs.org\/A\/RES\/76\/262\" target=\"_blank\" rel=\"noopener noreferrer\">resolution<\/a>\u00a0deciding to hold the P5 accountable for using their veto power, a move triggered by Russia\u2019s full-scale invasion of Ukraine in early 2022 and subsequent Security Council deadlock on that situation.<\/p>\n<p>At the request of Member States, the Assembly President can convene a formal meeting within 10 working days of the casting of a veto by one or more permanent Council members. But urgent global discussions can result in collective action. In the case of ongoing conflict, such action can include helping to stop the bloodshed, establishing a ceasefire, and easing civilian suffering on the ground.<\/p>\n<p>Given the daily rising daily death toll amid the ongoing conflict, if requested to do so by the Security Council on the vote of any seven of its members, or by a majority of the entire UN membership, the General Assembly President must convene within 24 hours an\u00a0<a href=\"https:\/\/www.un.org\/en\/ga\/sessions\/emergency.shtml#:~:text=If%20not%20in%20session%20at,Members%20of%20the%20United%20Nations%22.\">emergency special session<\/a>.<\/p>\n<p>Once convened, under a landmark 1950 resolution widely known as \u2018<a href=\"http:\/\/undocs.org\/en\/A\/RES\/377(V)\" target=\"_blank\" rel=\"noopener noreferrer\">Uniting for peace<\/a>\u2019, the UN\u2019s entire membership would consider the matter immediately with a view to making appropriate recommendations for collective measures. Only\u00a0<a href=\"https:\/\/www.un.org\/en\/ga\/sessions\/emergency.shtml\">11<\/a>\u00a0emergency special sessions of the General Assembly have been convened since 1945, five pertaining to the Middle East. A new session would come only one year after its predecessor.<\/p>\n<p>The\u00a0<a href=\"https:\/\/www.un.org\/en\/ga\/sessions\/emergency11th.shtml\">eleventh<\/a>\u00a0emergency special session was\u00a0<a href=\"https:\/\/undocs.org\/S\/RES\/2623(2022)\" target=\"_blank\" rel=\"noopener noreferrer\">convened<\/a>\u00a0in late February 2022, six days after Russia\u2019s full-scale invasion of Ukraine.<\/p>\n<p>Prior to that, the\u00a0<a href=\"https:\/\/www.un.org\/en\/ga\/sessions\/emergency10th.shtml\">tenth<\/a>\u00a0such session pertained to \u201cillegal Israeli actions in occupied East Jerusalem and the rest of the Occupied Palestinian Territory\u201d, which may be resumed by the Assembly President at the\u00a0<a href=\"https:\/\/undocs.org\/A\/RES\/ES-10\/20\" target=\"_blank\" rel=\"noopener noreferrer\">request<\/a>\u00a0of Member States.<\/p>\n<p>The first emergency special session opened at UN Headquarters on 1 November 1956, focusing on the Middle East, including some of the\u00a0<a href=\"https:\/\/undocs.org\/a\/pV.561\" target=\"_blank\" rel=\"noopener noreferrer\">issues<\/a>\u00a0currently facing a deadlocked Security Council.<\/p>\n<div class=\"align-center context-un_news_full_width_credit_caption type-entermedia_image media media--type-entermedia-image media--view-mode-un-news-full-width-credit-caption\" data-quickedit-entity-id=\"media\/126322\">\n<div class=\"field field--name-thumbnail field--type-image field--label-hidden field__item\"><img decoding=\"async\" class=\"lazyload aligncenter\" title=\"Medical supplies which were already in Gaza are being distributed by UNICEF.\" src=\"data:image\/svg+xml,%3Csvg%20xmlns%3D%27http%3A%2F%2Fwww.w3.org%2F2000%2Fsvg%27%20width%3D%271170%27%20height%3D%27530%27%20viewBox%3D%270%200%201170%20530%27%3E%3Crect%20width%3D%271170%27%20height%3D%27530%27%20fill-opacity%3D%220%22%2F%3E%3C%2Fsvg%3E\" data-orig-src=\"https:\/\/global.unitednations.entermediadb.net\/assets\/mediadb\/services\/module\/asset\/downloads\/preset\/Libraries\/Production%20Library\/16-10-2023_UNICEF_Gaza-04.jpg\/image1170x530cropped.jpg\" alt=\"Medical supplies which were already in Gaza are being distributed by UNICEF.\" width=\"1170\" height=\"530\" \/><\/div>\n<div class=\"field field--name-field-authors field--type-entity-reference field--label-hidden field__items\" style=\"text-align: center\">\n<div class=\"field__item\">\u00a9 UNICEF\/Mohammad Ajjour<\/div>\n<\/div>\n<div class=\"field field--name-field-title field--type-string field--label-hidden field__item\" style=\"text-align: center\">Medical supplies which were already in Gaza are being distributed by UNICEF.<\/div>\n<\/div>\n<h2><strong>Does Council inaction mean the UN\u2019s hands are tied?<\/strong><\/h2>\n<p>No.<\/p>\n<p>While the Security Council continues to consider the current situation in the Middle East, UN\u00a0<a href=\"https:\/\/news.un.org\/en\/story\/2023\/10\/1142442\">diplomatic<\/a>\u00a0and\u00a0<a href=\"https:\/\/news.un.org\/en\/story\/2023\/10\/1142262\">humanitarian<\/a>\u00a0efforts have been fully mobilized since the conflict\u2019s outbreak, including the UN Secretary-General\u2019s\u00a0<a href=\"https:\/\/peacemaker.un.org\/peacemaking-mandate\/secretary-general\">good offices<\/a>.<\/p>\n<p>As the Secretary-General and his top political and humanitarian envoys have headed to the region, UN agencies have been scrambling around the clock to help besieged Palestinians in Gaza and the occupied West Bank since the conflict began and even before.
