\t<\/span>In April 1991, the Committee on the Exercise of the Inalienable Rights of the Palestinian People requested that the Division for Palestinian Rights of the Â鶹APP Secretariat prepare urgently and update regularly, for the use of the Committee members and observers, a compilation of relevant recent statements, declarations and proposals regarding the settlement of the Arab-Israeli conflict, including the question of Palestine and the convening of the International Peace Conference on the Middle East.  The first issue of the publication, prepared in response to the decision of the Committee, appeared the same month.<\/p><\/div>\n

\n

\t<\/span>On 4 February 1992, at Larnaca, Cyprus, in an interview with an Al-Diyar<\/u> correspondent, the Foreign Minister of the Syrian Arab Republic Farouk al-Sharaa expressed his views on the Moscow multilateral negotiations.  In response to a question on his evaluation of the Moscow round, Mr. al-Sharaa said:<\/p><\/div>\n

\n\t\t\t\t\t<\/span>"As everyone knows, Syria did not participate in the multilateral talks because our policy was and still is that these talks should not be held before the bilateral talks bear the necessary fruit; namely, Israel's withdrawal from the occupied Arab territories and the restoration of the Palestinian people's national rights.\n\t\t\t\t<\/div>\n

<\/p>\n

\n\t\t\t\t\t<\/span>"Unless these results are achieved, no one can seriously think about Israel and the Arab States establishing any type of cooperative relations."1<\/u>\/\n\t\t\t\t<\/div>\n
\n

\t<\/span>On the question of his delegation's absence  at  the  Moscow  negotiations, Mr. al-Sharaa said:<\/p><\/div>\n

\n\t\t\t\t\t<\/span>"According to what I heard from the Arab delegations which attended the Moscow talks, Syria's absence greatly influenced the course of the talks and their failure.  Everybody realized that Syria was right not to participate in these talks.  We do not, therefore, regret not participating in the Moscow talks."1<\/u>\/\n\t\t\t\t<\/div>\n

Statement by the European community on the Middle East peace process<\/u><\/strong>,<\/strong><\/p><\/div>\n

\t<\/span>The following is the text of a statement of the Presidency of the European Community on the Middle East, issued at Lisbon, on 17 February 1992:<\/p><\/div>\n

\n\t\t\t\t"Statement on the Middle East process<\/u>\n\t\t\t\t<\/div>\n

<\/p>\n

\n\t\t\t\t\t<\/span>"The Community and its member States are following closely the developments in the Middle East peace process in both its bilateral and multilateral tracks.\n\t\t\t\t<\/div>\n

<\/p>\n

\n\t\t\t\t\t<\/span>"The achievement of lasting peace in the region is of vital importance for Europe.  This is why the community and its member States are fully committed to playing a consistent role in this process, bearing in mind that the Middle East is a neighbouring region, with which Europe has long-standing political, historical, cultural, economic and commercial ties, whose stability and security are essential to Europe's own stability and security.\n\t\t\t\t<\/div>\n

<\/p>\n

\n\t\t\t\t\t<\/span>"The Community and its member States have maintained regular contacts with the parties to the bilateral negotiations as well as with the co-sponsors and other participants.  The Community and its member States will not spare any efforts to provide their good offices if requested by the parties involved themselves.\n\t\t\t\t<\/div>\n

<\/p>\n

\n\t\t\t\t\t<\/span>"The inception of the multilateral phase of the Middle East peace process in Moscow has the potential to reinforce the bilateral talks.  It is in itself a concrete confidence-building measure, enabling peace to become a reality and genuine regional cooperation to develop.  However, substantive progress in the multilaterals can only be attained if the central issues of the bilaterals also register some progress.\n\t\t\t\t<\/div>\n

<\/p>\n

\n\t\t\t\t\t<\/span>"The Community and its member States reiterate their commitment to play a constructive and active role in the multilateral negotiations.  To this end, some obstacles should be overcome.  First of all, the presence of all the parties directly involved is essential in the next phases of the multilateral process.  Secondly, a formula allowing for a broader Palestinian participation should be sought.  Thirdly, the Â鶹APP and their specialized agencies should participate and contribute to the building up of regional cooperation.  Fourthly, the Community and its member States should participate, preferably as co-organizer, in all working groups established for the multilateral negotiations.  They believe it is necessary to be fully engaged in working groups of a clearly political nature, such as "Arms Control and Regional Security", besides their full involvement in working groups of an economic nature.\n\t\t\t\t<\/div>\n

<\/p>\n

\n\t\t\t\t\t<\/span>"The Community and its member States strongly urge all parties to commit themselves to the peace process and to refrain from taking any action which would endanger the negotiations or undermine the establishment of a climate of confidence, including the pursuit of the current settlement policy.  Furthermore, the Community and its member States condemn the perpetration of acts of violence, whatever their origin."2<\/u>\/\n\t\t\t\t<\/div>\n

\n\t\t\t\t\t\t<\/span>"a.\t<\/span>The concept of interim arrangements for the Palestinian Arab inhabitants for five years stems from the basic premises that:\n\t\t\t\t<\/div>\n

<\/p>\n

\n\t\t\t\t"-\t<\/span>The wounds inflicted by the long and bitter Arab-Israeli conflict need a time for healing, and trust must be built gradually.\n\t\t\t\t<\/div>\n

<\/p>\n

\n\t\t\t\t"-\t<\/span>The deeply differing points of view of the parties concerned cannot be bridged in one comprehensive step.  The gap can be bridged only through a process of building coexistence, through interim arrangements followed by an agreement on final status.\n\t\t\t\t<\/div>\n

\n\t\t\t\t"b.\t<\/span>The interim period must present an opportunity:\n\t\t\t\t<\/div>\n

<\/p>\n

\n\t\t\t\t"-\t<\/span>to examine and test the arrangements agreed upon for this period, including the fulfilment of all commitments;\n\t\t\t\t<\/div>\n

<\/p>\n

\n\t\t\t\t"-\t<\/span>to accommodate to the reality of living together on the same soil;\n\t\t\t\t<\/div>\n

<\/p>\n

\n\t\t\t\t"c.\t<\/span>The interim arrangements should create a change in the reality of life of the Palestinian Arabs in the territories; this change must be delineated by certain guidelines:\n\t\t\t\t<\/div>\n

\n\t\t\t\t"-\t<\/span>it should not prejudge the outcome of the final status negotiations;\n\t\t\t\t<\/div>\n

<\/p>\n

\n\t\t\t\t"-\t<\/span>it must deal with people, not with the status of the territories;\n\t\t\t\t<\/div>\n

\n\t\t\t\t"-\t<\/span>it must be based on a strict adherence to the arrangements as agreed before the implementation; and\n\t\t\t\t<\/div>\n

\n\t\t\t\t"a.\t<\/span>The interim arrangements are based on the agreed terms of reference that stipulate an agreement on:\n\t\t\t\t<\/div>\n

\n\t\t\t\t"-\t<\/span>establishment of interim self-government arrangements for the Palestinian Arab inhabitants of the territories;\n\t\t\t\t<\/div>\n

\n\t\t\t\t"-\t<\/span>keeping the established links between Judea, Samaria, Gaza District and Israel intact;\n\t\t\t\t<\/div>\n

<\/p>\n

\n\t\t\t\t"-\t<\/span>The Palestinian Arab inhabitants will be given, in the framework of the interim self-government arrangements, an opportunity to run their own affairs in most spheres, according to the agreement.\n\t\t\t\t<\/div>\n

\n\t\t\t\t"-\t<\/span>Residual powers and certain responsibilities will be reserved by Israel.\n\t\t\t\t<\/div>\n

<\/p>\n

\n\t\t\t\t"1.\t<\/span>Modalities<\/u>\n\t\t\t\t<\/div>\n

<\/p>\n

\n\t\t\t\t\t<\/span>"The organs of the ISGA, which will be agreed upon by the parties concerned, will be established in an agreed way.\n\t\t\t\t<\/div>\n

<\/p>\n

\n\t\t\t\t"2.\t<\/span>Structure and Procedure<\/u>\n\t\t\t\t<\/div>\n

<\/p>\n

\n\t\t\t\t\t<\/span>"a.\t<\/span>The organs of the interim self-government arrangements will be of administrative-functional nature.\n\t\t\t\t<\/div>\n

<\/p>\n

\n\t\t\t\t\t<\/span>"b.\t<\/span>The basic structural and functional configurations of the ISGA will be determined in the course of the negotiations.\n\t\t\t\t<\/div>\n

\n\t\t\t\t"3.\t<\/span>Jurisdiction<\/u>\n\t\t\t\t<\/div>\n

<\/p>\n

\n\t\t\t\t\t<\/span>"The jurisdiction of the ISGA organs will apply to the Palestinian Arab inhabitants of Judea, Samaria and the Gaza District.\n\t\t\t\t<\/div>\n

\n\t\t\t\t"4.\t<\/span>Powers and Responsibilities<\/u>\n\t\t\t\t<\/div>\n

<\/p>\n

\n\t\t\t\t\t<\/span>"a.\t<\/span>In the negotiations, Israel will propose to negotiate delegation of powers and responsibilities to the proper organs of ISGA in the following spheres of operation (subject to agreement on the general concept and structure, and to coordination and cooperation arrangements, as well as Jordanian-related aspects):\n\t\t\t\t<\/div>\n

<\/p>\n

\n\t\t\t\t"(1)\t<\/span>Administration of Justice<\/u> – Supervision of the administrative system of local courts in the areas; dealing with matters connected with the prosecution system and with the registration of companies and partnerships.\n\t\t\t\t<\/div>\n

<\/p>\n

\n\t\t\t\t"(2)\t<\/span>Administrative Personnel Matters –<\/u> Appoint- ments and working conditions of employees (At the present time the civil service of the inhabitants of Judea-Samaria and Gaza, within the framework of the Military Government's Civilian Administration, comprises approximately 20,000 persons.)\n\t\t\t\t<\/div>\n

<\/p>\n

\n\t\t\t\t"(3)\t<\/span>Agriculture<\/u> – Various branches of agricul- ture, fisheries, etc.\n\t\t\t\t<\/div>\n

<\/p>\n

\n\t\t\t\t"(4)\t<\/span>Education and Culture<\/u> – Operation of the network of schools in the areas, from nursery to higher education; supervision of cultural, artistic and sporting activities.\n\t\t\t\t<\/div>\n

\n\t\t\t\t\t<\/span>"The powers and responsibilities of the organs of the ISGA will not apply to the Israel Defence Forces or to Israeli civilians in Judea, Samaria and Gaza District, as well as to the Palestinian Arabs who reside in Jerusalem, the capital of Israel, which is not part of the territories.\n\t\t\t\t<\/div>\n

<\/p>\n

\n\t\t\t\t"b.\t<\/span>Security<\/u>\n\t\t\t\t<\/div>\n

<\/p>\n

\n\t\t\t\t"-\t<\/span>The sole responsibility for external and internal security as well as public order will be that of Israel.\n\t\t\t\t<\/div>\n

\n\t\t\t\t"-\t<\/span>In the area of public order there will be cooperation between the Israeli relevant autho- rities and the local police force.\n\t\t\t\t<\/div>\n

\n\t\t\t\t"-\t<\/span>The powers to promulgate regulations in the spheres of operation of the organs of the ISGA will be determined in the agreement, subject to coordination and cooperation with Israel as mentioned above."3<\/u>\/\n\t\t\t\t<\/div>\n

\t<\/span><\/strong>"<\/strong><\/i>The agenda in the negotiations and general concept ideas<\/u><\/strong><\/i><\/p><\/div>\n

\n\t\t\t\t"A.\t<\/span>In order to proceed in our negotiations, we ought to agree first on the agenda, which encompasses issues of substance.\n\t\t\t\t<\/div>\n

<\/p>\n

\n\t\t\t\t"B.\t<\/span>Our concept of the interim self-government arrangements, for five years, as expressed in our agenda proposal, is based on the following:\n\t\t\t\t<\/div>\n

<\/p>\n

\n\t\t\t\t"(1)\t<\/span>The interim self-government arrangements must provide for a period of healing, rehabilitation and confidence-building in our relationship with the Palestinian Arabs in the territories, following a long conflict and against the well-known regional background.\n\t\t\t\t<\/div>\n

<\/p>\n

\n\t\t\t\t"(2)\t<\/span>(a)\t<\/span>The interim self-government arrangements concept includes the delegation of a wide list of powers encompassing the life of the Palestinian Arab population in the territories to representatives of the population.  When the arrangements are agreed and implemented, the Palestinians in the territories will be able to run their own affairs in many sphere, in fact, the majority of their walks of life.\n\t\t\t\t<\/div>\n

<\/p>\n

\n\t\t\t\t\t<\/span>"(b)  The interim self-government arrangements should be fair to the Arab population but not hamper the rights of Jews.  They cannot compromise Israel's security, which — given the well-known circumstances of terrorist attacks, as well as other threats — is faced with a clear and present danger.  That is why security responsibility must remain with Israel; this is a vital strategic must.\n\t\t\t\t<\/div>\n

<\/p>\n

\n\t\t\t\t"(3)  The interim self-government arrangements should be achieved without prejudice to the final status of the territories, to be negotiated beginning the third year, as understood.  Until the final status is agreed upon, the present source of authority will remain intact.\n\t\t\t\t<\/div>\n

<\/p>\n

\n\t\t\t\t"(4)  The arrangements will apply to the Palestinian Arab inhabitants of the territories under Israeli military administration.  The arrangements will not have a territorial application, nor will they apply to the Israeli population in the territories.  They will not include inhabitants of Jerusalem.\n\t\t\t\t<\/div>\n

<\/p>\n

\n\t\t\t\t"C.\t<\/span>We shall share with you our reasons for not accept your agenda ideas as proposed, as well as your model, which — as indicated in my letter of January 16, 1992 — is a far cry from acceptable interim self-government arrangements and which basically represents a Palestinian State in all but name, considered by Israel a mortal security threat.  Your agenda and model proposals appear to reflect disengagement on your part from the spirit of the agreed staged framework for negotiations, which is the only hope for progress.  Nor can we accept preconditions of any kind, as introduced and announced by you during the former round of negotiations.\n\t\t\t\t<\/div>\n

<\/p>\n

\n\t\t\t\t"D.\t<\/span>Israel's basic approach to the arrangements is founded in principle developments since 1978.  We regret, however, that during the negotiations you have rejected the Camp David Accords.\n\t\t\t\t<\/div>\n

\n\t\t\t\t"I.\t<\/span>The list of spheres to be delegated, subject to the necessary understandings, is suggested by us as part of the agenda.\n\t\t\t\t<\/div>\n

\n\t\t\t\t"J.\t<\/span>In light of the above, we should work on the agenda in a realistic and swift way and further continue our deliberations on substance.\n\t\t\t\t<\/div>\n
