CREDENTIALS OF REPRESENTATIVES TO TEE THIRTY-NINTH SESSION <\/p><\/div>\n

<\/p>\n

\n

Letter dated 16 October 1984 from the representatives of Afghanistan, Algeria, Bahrain, Bangladesh, Benin,<\/u><\/p><\/div>\n

\n

Bulgaria, the Byelorussian Soviet Socialist Republic, China, the Comoros, Cuba, Czechoslovakia, Democratic<\/u><\/p><\/div>\n

\n

Yemen, Djibouti, the Gambia, the German Democratic Republic, Guinea, Hungary, Indonesia, Iran (Islamic<\/u><\/p><\/div>\n

\n

Republic of), Iraq, Jordan, Kuwait, Lebanon, the Libyan Arab Jamahiriya, Malaysia, Maldives, Mali, <\/u><\/p><\/div>\n

to the Â鶹APP addressed to the President of the General Assembly<\/u><\/p><\/div>\n

\n

\t<\/span>The undersigned have the honor to inform you, on behalf of their respective Governments, that they are entering reservations concerning the credentials of the delegation of Israel to the thirty-ninth session of the General Assembly.<\/p><\/div>\n

<\/p>\n

\n

1.\t<\/span>Israel is continuing its flagrant and persistent violation of the Charter of the Â鶹APP and the principles of international law and to flout with impunity the resolutions of our organization concerning the question of Palestine and the situation in the Middle East.<\/p><\/div>\n

<\/p>\n

\n

2.\t<\/span>Israel has refused to implement the resolutions of the Security Council and the General Assembly concerning the city of Jerusalem which it has illegally annexed and made its capital. Furthermore, Israel has submitted its credentials issued in Jerusalem, thus defying General Assembly resolutions, particularly resolution 35\/169 E of 15 December 1980 which, inter alia<\/u>, determined that all legislative and administrative measures and actions taken by Israel, the occupying Power, which have altered or purport to alter the character and status of the Holy City of Jerusalem, and, in particular, the recent "Basic Law" on Jerusalem and the proclamation of Jerusalem as the capital of Israel, are null and void and must be rescinded forthwith and urged all States, specialized agencies and other international organizations not to conduct any business which is not in conformity with the above.<\/p><\/div>\n

<\/p>\n

\n

3.\t<\/span>Israel has refused to implement the relevant resolutions of the Security Council and the General Assembly calling upon it to annul forthwith its decision of 14 December 1981 to impose its laws, jurisdiction and administration on the Syrian Golan Heights.<\/p><\/div>\n

<\/p>\n

\n

4.\t<\/span>Israel has systematically refused to implement the resolutions of the Â鶹APP relating to the inalienable legitimate rights of the Palestinian people to self-determination and to the establishment of its own independent State in Palestine, and has continued its illegal occupation of the Palestinian territories, including the Holy City of Jerusalem.<\/p><\/div>\n

<\/p>\n

\n

5.\t<\/span>Israel has rejected the relevant resolutions of the Security Council and the General Assembly declaring illegal its policy of establishing settlements which it uses to consolidate its control over the occupied Arab territories, to alter their geographical, demographic, cultural and social character and to create a situation of fait accompli<\/u>. This policy, which contravenes the fourth Geneva Convention of 1949, has doubled the number of Israeli settlements in the space of three years and initiated a new and even more dangerous phase consisting of the establishment of Jewish settlements in the Arab towns of the occupied territories.<\/p><\/div>\n

<\/p>\n

\n

6.\t<\/span>Israel has invaded Lebanon and maintains troops there in defiance of the Charter and resolutions of the Â鶹APP and of international law. It has committed atrocities and odious crimes against the Palestinian and Lebanese people, to which the collective massacre of the Palestinian inhabitants of Sabra and Shatila will forever testify.<\/p><\/div>\n

<\/p>\n

\n

7.\t<\/span>Israel has persistently failed to carry out the provisions of Security Council resolutions 508 (1982) and 509 (1982) which demanded the total and unconditional withdrawal of Israeli forces of occupation from all of Lebanon.<\/p><\/div>\n

<\/p>\n

\n

8.\t<\/span>Israel systematically resorts to intimidation and the use of force in the name of prevention and security, and to biblical and other fallacious arguments to extend its supremacy over the neighboring Arab countries.<\/p><\/div>\n

<\/p>\n

\n

9.\t<\/span>The General Assembly has already stated in its resolution ES-9\/1 of 5 February 1982 that the measures taken in the past by Israel and its actions confirm that it is not a peaceful State and that it has not fulfilled its obligations under the Charter, nor its commitments under General Assembly resolution 273 (III) of 11 May 1949.<\/p><\/div>\n

The undersigned reserve the right to raise this question at the appropriate time and request you to circulate the present letter as an official document of the General Assembly <\/strong>under agenda item 3.<\/p><\/div>\n
