PALESTINIAN RIGHTS COMMITTEE CONSIDERS ITS REPORT<\/u><\/p><\/div>\n

\n

     The Committee on the Exercise of the Inalienable Rights of the<\/p><\/div>\n

\n

Palestinian People this morning considered its draft report and recommendations to the Secretary-General, and heard the views and suggestions of its members.<\/p><\/div>\n

<\/p>\n

\n

     The Committee, established under the General Assembly resolution <\/span>3376 (XXX)<\/a>, is requested under the same resolution to submit its report and recommendations to the Secretary-General no later than 1 June 1976, who, in turn, would transmit the report to the Security Council for consideration. The Security Council is requested, under the resolution, to consider, as soon as possible after 1 June 1976, the question of the exercise by the Palestinian people of the inalienable rights recognized in resolution <\/span>3236 (XXIX)<\/a>.<\/span><\/p><\/div>\n

<\/p>\n

\n

     Statements on the draft report, which was introduced this morning by<\/p><\/div>\n

\n

Victor J. Gauci (Malta), Rapporteur of the Committee, were made by the<\/p><\/div>\n

\n

representatives of Tunisia, Hungary, Yugoslavia, Romania, German Democratic<\/p><\/div>\n

\n

Republic, Turkey, India, Cyprus, Ukraine, Lao Republic, Indonesia and<\/p><\/div>\n

\n

Madagascar.  Observers from Syria and the Palestinian Liberation Organization<\/p><\/div>\n

\n

(PLO) also spoke on the draft report.<\/p><\/div>\n

<\/p>\n

\n

     In summarizing the debate, Ricardo Alarcon Quesada (Cuba), Chairman of<\/p><\/div>\n

\n

the Committee, said that the Committee thus agreed, in principle, to the<\/p><\/div>\n

\n

adoption of the draft report, which would be further revised to reflect the<\/p><\/div>\n

\n

comments made today by delegations.<\/p><\/div>\n

<\/p>\n

\n

     The Committee will meet again on 20 May, when it is expected to take<\/p><\/div>\n

\n

final action on the draft report.<\/p><\/div>\n

<\/p>\n

\n

     Details of Draft Report<\/u><\/p><\/div>\n

<\/p>\n

\n

     In addition to summarizing the deliberations of the Committee, the<\/p><\/div>\n

\n

draft report contains a series of recommendations made on the belief that<\/p><\/div>\n

\n

"the question of Palestine is at the heart of the Middle East problem" and,<\/p><\/div>\n

\n

therefore, no solution in the area could be envisaged without taking into<\/p><\/div>\n

\n

account the "legitimate aspirations of the Palestinian people".<\/p><\/div>\n

<\/p>\n

\n

     In the draft report, the Committee endorses the "legitimate and<\/p><\/div>\n

\n

inalienable rights of the Palestinian people to return to their homes<\/p><\/div>\n

\n

and property and to achieve self-determination, national independence<\/p><\/div>\n

\n

and sovereignty" and states that the full implementation of these rights<\/p><\/div>\n

\n

would "contribute decisively" to a comprehensive and final settlement of<\/p><\/div>\n

\n

the Middle East issue.  The Committee also maintains that the participation of <\/p><\/div>\n

\n

the PLO on an equal footing with other parties was "indispensable in all efforts, deliberations and conferences on the Middle East which are held under the auspices of the Â鶹APP".<\/p><\/div>\n

<\/p>\n

\n

     The Committee also recommends in the report that the Â鶹APP<\/p><\/div>\n

\n

and its organs should play a "more influential role" in promoting a just<\/p><\/div>\n

\n

solution to the question of Palestine.  Further, the Security Council,<\/p><\/div>\n

\n

in particular, should "take appropriate action to facilitate the exercise<\/p><\/div>\n

\n

by the Palestinians of their right to return to their homes, lands and<\/p><\/div>\n

\n

property", the report recommends.<\/p><\/div>\n

<\/p>\n

\n

     On the right of return of the Palestinian people to their homes,<\/p><\/div>\n

\n

the Committee recommends that the programme of implementation of the<\/p><\/div>\n

\n

exercise of this right should be carried out in two phases, the first<\/p><\/div>\n

\n

phase involving the return of the Palestinians displaced as a result<\/p><\/div>\n

\n

of the war of June 1967, and the second phase involving the return of<\/p><\/div>\n

\n

those displaced between 1948 and 1967.  In the implementation of phase<\/p><\/div>\n

\n

one, the Security Council would be requested to call on the immediate<\/p><\/div>\n

\n

implementation of its resolution <\/span>237 (1967)<\/a>, while the International<\/span><\/p><\/div>\n

\n

Committee of the Red Cross and\/or the Â鶹APP Relief and Works<\/p><\/div>\n

\n

Agency for Palestine Refugees in the Near East (UNRWA) might be asked<\/p><\/div>\n

\n

to "assist in the solution of any logistical problems involved in the<\/p><\/div>\n

\n

resettlement" of those returning to their homes.  The Committee also<\/p><\/div>\n

\n

stipulates that these agencies could also assist, in co-operation with<\/p><\/div>\n

\n

the host countries and the PLO, in the identification of the displaced<\/p><\/div>\n

\n

Palestinians.<\/p><\/div>\n

<\/p>\n

\n

     Further, while the first phase was being implemented, the United<\/p><\/div>\n

\n

Nations, in co-operation with the States directly involved and the PLO,<\/p><\/div>\n

\n

would be asked to make necessary arrangements to help the Palestinians<\/p><\/div>\n

\n

displaced between 1948 and 1967 to exercise their right to return to<\/p><\/div>\n

\n

their homes.  The Committee also recommends that those Palestinians not<\/p><\/div>\n

\n

choosing to return to their homes should be paid "just and equitable<\/p><\/div>\n

\n

compensation" as provided for in General Assembly resolution 194 (III).<\/p><\/div>\n

<\/p>\n

\n

     As regards the Palestinian right to self-determination, national<\/p><\/div>\n

\n

independence and sovereignty, the Committee recommends that the Security<\/p><\/div>\n

\n

Council establish a time-table for the complete withdrawal by Israel<\/p><\/div>\n

\n

from those areas occupied in 1967, and that such withdrawal should be<\/p><\/div>\n

\n

completed no later than 1 June 1977.  Further, the Committee recommends,<\/p><\/div>\n

\n

in its draft report, that the Council request Israel to desist from the<\/p><\/div>\n

\n

establishment of new settlements and to withdraw during this period<\/p><\/div>\n

\n

from settlements established since 1967 in the occupied territories.<\/p><\/div>\n

\n

Arab property and all essential services in these areas should be<\/p><\/div>\n

\n

maintained intact, the Committee recommends.<\/p><\/div>\n

<\/p>\n

\n

     The Committee further recommends that the evacuated territories, with<\/p><\/div>\n

\n

all property and services intact, may be handed over to the Â鶹APP<\/p><\/div>\n

\n

which, with the co-operation with the League of Arab States, would sub-<\/p><\/div>\n

\n

sequently hand over these evacuated areas to the PLO as the representative<\/p><\/div>\n

\n

of the Palestinian people.  Further, the Â鶹APP would be asked to<\/p><\/div>\n

\n

provide the economic and technical assistance necessary for the consolidation<\/p><\/div>\n

\n

of the Palestinian entity.<\/p><\/div>\n

<\/p>\n

\n

     Statements Made<\/u><\/p><\/div>\n

<\/p>\n

\n

     RACHID DRISS (Tunisia) said the Committee should adopt the draft report<\/p><\/div>\n

\n

in principle, but that all the stylistic revisions orally introduced today<\/p><\/div>\n

\n

should be presented in a corrected version.  He wished that a separate<\/p><\/div>\n

\n

document would be issued containing the list of 188 resolutions adopted by<\/p><\/div>\n

\n

the General Assembly and the Security Council thus far on the Palestine<\/p><\/div>\n

\n

question.<\/p><\/div>\n

<\/p>\n

\n

     The Secretary-General, he said, should be asked to extensively<\/p><\/div>\n

\n

disseminate the recommendations formulated by the Committee.<\/p><\/div>\n

<\/p>\n

\n

     REZSO BANYASZ (Hungary) said his delegation had firm conviction that<\/p><\/div>\n

\n

the "dangerous hot-bed in the Middle East has been created and maintained<\/p><\/div>\n

\n

by imperialist manoeuvres, by colonialist designs".  The implementation<\/p><\/div>\n

\n

of the legitimate and inalienable rights of the Palestinian people to<\/p><\/div>\n

\n

sovereign national existence, to homeland and to return he said, was a<\/p><\/div>\n

\n

cornerstone of any possible just and lasting, peaceful solution of the<\/p><\/div>\n

\n

Middle East conflict.  Without putting an end to the "striking injustices<\/p><\/div>\n

\n

and untold sufferings" that had afflicted the Arab people of Palestine for<\/p><\/div>\n

\n

over a quarter of century, there would be no peace in the Middle East, he<\/p><\/div>\n

\n

asserted.  Further, his delegation believed that the participation of the<\/p><\/div>\n

\n

"Palestine Liberation Organization, the representative of the Palestinian<\/p><\/div>\n

\n

people" on an equal footing with other parties … was indispensable in<\/p><\/div>\n

\n

all efforts, deliberations and conferences on the Middle East.<\/p><\/div>\n

<\/p>\n

\n

     The draft report of the Committee, he said, clearly showed the basis<\/p><\/div>\n

\n

conviction of the members of the Committee that the right of return and the<\/p><\/div>\n

\n

right to a homeland of the Palestinian Arab people were not negotiable.<\/p><\/div>\n

\n

The Â鶹APP, he said, had the obligation to implement the "long<\/p><\/div>\n

\n

overdue resolutions" and to help in the solution of the many political and<\/p><\/div>\n

\n

practical matters in a way the draft report suggested.  It was clear, he<\/p><\/div>\n

\n

said, that the Middle East question was a question of basic concern to<\/p><\/div>\n

\n

international peace and security, and as such belongs, first and foremost,<\/p><\/div>\n

\n

to the sphere of competence of the Security Council.<\/p><\/div>\n

<\/p>\n

\n

     Stating that the socialist countries — among them Hungary — had no<\/p><\/div>\n

\n

selfish interests in the Middle East, he asserted that the interest of the<\/p><\/div>\n

\n

socialist countries was to promote peace based on justice, security through<\/p><\/div>\n

\n

peaceful co-operation of all the nations of the region.<\/p><\/div>\n

<\/p>\n

\n

     JAKSA PETRIC (Yugoslavia) said the draft report, which successfully<\/p><\/div>\n

\n

compiled the views of the Committee members, should be adopted.<\/p><\/div>\n

<\/p>\n

\n

     ION DATCU (Romania), supporting the adoption of the draft report, said<\/p><\/div>\n

\n

that the Committee could then complete its task before 1 June, as stipulated<\/p><\/div>\n

\n

in the General Assembly resolutions.<\/p><\/div>\n

<\/p>\n

\n

     PETER FLORIN (German Democratic Republic) said that, although his<\/p><\/div>\n

\n

delegation had some reservations on certain points contained  in the draft<\/p><\/div>\n

\n

report, it supported the idea of adopting the report by consensus.<\/p><\/div>\n

<\/p>\n

\n

     The Israeli authorities, he said, continued to practice its Zionist<\/p><\/div>\n

\n

policies, thus aggravating the efforts to restore the rights of the<\/p><\/div>\n

\n

Palestinian people.  Recently, his Government made a statement on the<\/p><\/div>\n

\n

Middle East situation, commending as "constructive" the Soviet policy as<\/p><\/div>\n

\n

proclaimed in April by that country.  His Government believed that the<\/p><\/div>\n

\n

Israeli authorities were blocking the way to a just and lasting solution.<\/p><\/div>\n

\n

Powerful imperialistic countries continued their assistance to Israel.<\/p><\/div>\n

<\/p>\n

\n

     Israel, he said, should withdraw its troops from the territories it<\/p><\/div>\n

\n

occupied in 1967.  The Geneva Peace Conference, he said, was a "suitable"<\/p><\/div>\n

\n

international forum for a just and stable peace in the Middle East.<\/p><\/div>\n

<\/p>\n

\n

     ILTER TURKMEN (Turkey) said that the draft report, taken as a whole,<\/p><\/div>\n

\n

reflected a well-balanced view of the Committee.  His delegation supported<\/p><\/div>\n

\n

the draft report.<\/p><\/div>\n

<\/p>\n

\n

     RIKHI JAIPAL (India) said that the draft report recognized that a<\/p><\/div>\n

\n

solution of the Middle East question depended on the co-operation between<\/p><\/div>\n

\n

the General Assembly and the Security Council.<\/p><\/div>\n

<\/p>\n

\n

     He made some suggestions for amending the text of the report and said<\/p><\/div>\n

\n

that the inclusion in the report of a possible role to be played by the<\/p><\/div>\n

\n

International Court of Justice might weaken the over-all effect of the<\/p><\/div>\n

\n

recommendations.  The question of the role of the World Court, he said,<\/p><\/div>\n

\n

could be dealt with outside the report.<\/p><\/div>\n

<\/p>\n

\n

     JOSEPH J. STEPHANIDES (Cyprus) said he agreed with the Indian<\/p><\/div>\n

\n

representative on the inclusion of a paragraph on the advisory opinion of<\/p><\/div>\n

\n

the International Court of Justice.<\/p><\/div>\n

<\/p>\n

\n

     He said the Security Council must take into account the "scrupulous<\/p><\/div>\n

\n

approach" the Committee had taken in discharging its mandate.<\/p><\/div>\n

<\/p>\n

\n

     VLADIMIR N. MARTYNENKO (Ukraine) said that genuine and lasting peace in<\/p><\/div>\n

\n

the Middle East could not be attained without the full restoration of the<\/p><\/div>\n

\n

Palestinian rights.  The 28 April statement by the Soviet Government this<\/p><\/div>\n

\n

year on the Middle East situation, he said, rightly stated that the in-<\/p><\/div>\n

\n

alienable rights of the Palestine people should be restored.<\/p><\/div>\n

<\/p>\n

\n

     It also recognized the political encouragements given to Israel by<\/p><\/div>\n

\n

certain Powers to undermine the efforts of those working for independence,<\/p><\/div>\n

\n

he said.  The Soviet statement, he noted, stated that the rights of the<\/p><\/div>\n

\n

Palestinian people should be fully satisfied, that the Israeli forces should<\/p><\/div>\n

\n

withdraw from the occupied territories, and that international peace and<\/p><\/div>\n

\n

security should be maintained.<\/p><\/div>\n

<\/p>\n

\n

     His delegation believed that the Soviet position, as presented in its<\/p><\/div>\n

\n

28 April statement, should be fully reflected in the report of the Committee.<\/p><\/div>\n

<\/p>\n

\n

     His delegation had certain reservations on the draft report before<\/p><\/div>\n

\n

the Committee but agreed, in principle, to the adoption of the report.<\/p><\/div>\n

<\/p>\n

\n

     KHAM THONG BOULOM (Lao Republic) said that his delegation supported<\/p><\/div>\n

\n

adoption of the draft report.<\/p><\/div>\n

<\/p>\n

\n

     AUGUST MARPAUNG (Indonesia) said his delegation believed the report<\/p><\/div>\n

\n

was "well-balanced", and "constructive in approach".  He supported the<\/p><\/div>\n

\n

Indian suggestion on the removal from the report of a reference to the<\/p><\/div>\n

\n

possible role of the International Court of Justice.  He commended the<\/p><\/div>\n

\n

positive role the PLO had played in the work of the Committee.<\/p><\/div>\n

<\/p>\n

\n

     ZEHDI L. TERZI, observer of the PLO, said that his organization was<\/p><\/div>\n

\n

"very grateful" to the Committee which put the question of Palestine in<\/p><\/div>\n

\n

its "proper perspective" and considered the matter in a very "serious"<\/p><\/div>\n

\n

manner.  He hoped a reference would be made in the report to the statements<\/p><\/div>\n

\n

made, respectively by Chairman Arafat and Mr. Kaddoumi of the PLO.<\/p><\/div>\n

<\/p>\n

\n

     As to the possible role of the International Court of Justice, the<\/p><\/div>\n

\n

sentence referring to it could be moved elsewhere in the report, so as to<\/p><\/div>\n

\n

avoid its being confused with the recommendations.  He hoped the Committee<\/p><\/div>\n

\n

would meet again towards the end of the month to consider further suggestions<\/p><\/div>\n

\n

for amendments.  He, for one, wished to send the draft report to his<\/p><\/div>\n

\n

headquarters for consideration before the Committee adopted the final<\/p><\/div>\n

\n

version.<\/p><\/div>\n

<\/p>\n

\n

     HENRI RASOLONDRAIBE (Madagascar) said more time should be given to<\/p><\/div>\n

\n

delegations to study in depth the draft report as a whole.  His delegation<\/p><\/div>\n

\n

was pleased with the recommendations contained in the report, as they<\/p><\/div>\n

\n

rightly reflected the belief that a solution to the Middle East crisis<\/p><\/div>\n

\n

could not be attained without the full recognition of the rights of the<\/p><\/div>\n

\n

Palestinian people.<\/p><\/div>\n

<\/p>\n

\n

     MOWAFFAK ALIAF (Observer of Syria), commenting on a number of oral<\/p><\/div>\n

\n

amendments suggested to the draft report, said that his delegation<\/p><\/div>\n

\n

supported the PLO request for inclusion in the report of a reference to<\/p><\/div>\n

\n

statements made by Chairman Arafat and Mr. Kaddoumi of the PLO.<\/p><\/div>\n

<\/p>\n

\n

     His delegation objected to a reference in the report to the possibility<\/p><\/div>\n

\n

that the International Court of Justice might be requested to consider the<\/p><\/div>\n

\n

validity of certain General Assembly resolutions which had already been<\/p><\/div>\n

\n

adopted.  Such an approach, he said, would undermine the very basis on which<\/p><\/div>\n

\n

the Committee's work was carried out.<\/p><\/div>\n

<\/p>\n

\n

     Furthermore, the question of Jerusalem, which the report briefly<\/p><\/div>\n

\n

referred to, fell outside the mandate of the Committee, he said.  The report<\/p><\/div>\n

\n

should also refrain from the use of such "dangerous" terms as "territorial<\/p><\/div>\n

\n

arrangements" and "future sovereignty", he said.<\/p><\/div>\n

<\/p>\n

\n

     He hoped the Committee would meet within one week or so to finalize the<\/p><\/div>\n

\n

report.<\/p><\/div>\n

<\/p>\n

\n

     Mr. JAIPAL (India) said his delegation shared the reservations expressed<\/p><\/div>\n

\n

by Syria concerning the question of Jerusalem and the use of certain words.<\/p><\/div>\n

\n

As to the paragraph on the possible role of the International Court of<\/p><\/div>\n

\n

Justice, he believed that it could either be deleted completely or be moved<\/p><\/div>\n

\n

to a more appropriate place in the report.<\/p><\/div>\n

<\/p>\n

\n

     Responding to comments, the Rapporteur of the Committee, VICTOR J. GAUCI<\/p><\/div>\n

\n

(Malta) said that an annex could be attached to the report containing the<\/p><\/div>\n

\n

list of resolutions of relevances to the Palestine question.  A reference<\/p><\/div>\n

\n

would also be made in the revised version to the statements made by Chairman<\/p><\/div>\n

\n

Arafat and Mr. Kaddoumi of the PLO.<\/p><\/div>\n

<\/p>\n

\n

     Furthermore, he believed that certain terms could be deleted or replaced<\/p><\/div>\n

\n

so as to avoid confusion<\/p><\/div>\n

<\/p>\n

\n

     On the possible role of the International Court of Justice, he personally<\/p><\/div>\n

\n

believed the reference could be deleted from the present draft.<\/p><\/div>\n

\n
